Debt Discharge Analysis
The discharge is a central goal of many personal bankruptcy cases, but it does not cover every obligation. A debt-by-debt review helps set realistic expectations before filing.
When this service may be relevant
Many unsecured obligations may be dischargeable, while domestic-support obligations, certain taxes and other statutory categories may survive. Student loans generally require additional litigation and a demanding legal showing. Secured creditors may retain lien rights even when personal liability is discharged.
What counsel should review
- Credit cards, medical bills and personal loans.
- Income, payroll, property and other taxes.
- Child support, alimony and divorce-related obligations.
- Student loans and educational debts.
- Debts involving fraud, fiduciary conduct or intentional injury allegations.
- Mortgages, vehicle liens, judgments and co-signed obligations.
Important limits and timing
A debt label on a credit report does not decide dischargeability. The underlying facts, dates, court orders and statutory exceptions control.
Does bankruptcy remove liens from my property?
A discharge generally addresses personal liability; valid liens may survive unless a specific bankruptcy procedure or other law changes them. Individual review is required.
